This website and online store are operated by OMNI COMMERCE GLOBAL LIMITED, trading as MeloNail ("MeloNail", "we", "us", or "our"). These Terms of Service govern your access to and use of melonail.com and any purchase you make from us. By using the site or placing an order, you agree to these Terms and the policies linked on our store. If you do not agree, do not use the services.

1. Eligibility and accounts

You must be at least the age of majority in your place of residence, or use the services with the consent and supervision of a parent or legal guardian. Information you provide must be accurate and current. You are responsible for safeguarding your account credentials and activity.

2. Products and information

We make reasonable efforts to display product descriptions, dimensions, colours, and images accurately. Screen settings, lighting, and the handmade nature of some products may result in minor variations. We may change descriptions, availability, or discontinue products without notice.

3. Product use

Follow the application, wear, care, and removal instructions supplied with our products. Nail adhesives and related products must be used only as directed. Do not apply products to damaged, inflamed, or infected nails or surrounding skin. Stop use and seek appropriate medical advice if irritation or an adverse reaction occurs. Product information on the site is general information and is not medical advice.

4. Orders

Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or dispatch the products. We may refuse or cancel an order for reasons including product unavailability, suspected fraud, pricing or description errors, delivery restrictions, or breach of these Terms. If we cancel after payment, we will refund the amount charged for the cancelled item.

Review your order carefully before submitting it. We cannot guarantee changes or cancellation after processing or fulfilment begins. Products are sold for personal use and not for unauthorised commercial resale.

5. Prices and payment

Prices and promotions may change without notice. The amount shown at checkout applies to your order. Unless expressly stated, product prices exclude shipping, import duties, taxes, and customs charges. You authorise us and our payment providers to charge the selected payment method for the total shown at checkout.

6. Shipping, returns, and refunds

Shipping is governed by our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Refund Policy. Delivery estimates are not guarantees, but nothing in these Terms excludes remedies that cannot lawfully be excluded.

7. Intellectual property

The site and its content, including our branding, product designs, photographs, text, graphics, and videos, are owned by or licensed to us and are protected by applicable intellectual-property laws. You may use the site only for personal, non-commercial shopping purposes. You may not copy, reproduce, distribute, modify, scrape, publish, sell, or exploit site content without prior written permission.

8. Prohibited use

You must not use the services unlawfully; infringe another person's rights; submit false or misleading information; introduce malicious code; interfere with security or site operation; attempt unauthorised access; harvest personal information; send spam; impersonate another person; or use automated tools in a way that places an unreasonable load on or disrupts the services.

Shopify and other third parties provide hosting, payment, delivery, analytics, and related services. Third-party websites and services are governed by their own terms and policies. We are not responsible for third-party content or services outside our reasonable control.

10. Reviews and feedback

If you submit a review, image, suggestion, or other content, you confirm that you have the right to do so and that it is accurate, lawful, and does not violate another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content for operating and promoting our business. We may remove content that violates these Terms.

11. Errors and availability

We may correct typographical errors, inaccuracies, or omissions and update information or cancel affected orders. Site access may occasionally be interrupted for maintenance, security, or reasons outside our control.

12. Disclaimer and limitation of liability

To the fullest extent permitted by law, the services are provided on an "as available" basis. We do not exclude any warranty, consumer guarantee, or liability that cannot lawfully be excluded. Subject to those rights, we are not liable for indirect, incidental, special, or consequential loss arising from use of the site or products, or for delay or failure caused by events outside our reasonable control.

13. Indemnity

To the extent permitted by law, you agree to indemnify us against third-party claims arising from your unlawful use of the services, your breach of these Terms, or your infringement of another person's rights.

15. Changes and termination

We may update these Terms by posting the revised version here. Material changes will take effect as stated in the notice or as required by law. We may suspend or terminate access where reasonably necessary for security, unlawful conduct, or breach of these Terms. Provisions that by their nature should survive termination will continue to apply.

16. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have non-exclusive jurisdiction, without limiting any mandatory consumer protection or right to bring a claim in another competent jurisdiction.

17. General

If any provision is found unenforceable, the remaining provisions remain effective. A delay in enforcing a right is not a waiver. These Terms and the policies referenced in them form the agreement between you and us concerning the services.
